Legal Protection Reform for Digital Gig Workers in Indonesia: A Comparative Analysis with the Netherlands

Abstract

This research aims to examine the inadequacy of Indonesia’s labor law framework in protecting digital gig workers and to propose a reform model inspired by the Dutch legal system. Employing a normative legal method, with legislative, conceptual, and comparative approaches. The study analyzes Indonesian labor regulations, notably the Employment Law, the Job Creation Law, and related ministerial decrees and compares them with the Netherlands' Burgerlijk Wetboek Articles 7:610a and 7:610aa. Data were collected from statutory materials, court decisions, and scholarly literature between 2020 and 2024. The findings reveal that Indonesia's formal approach fails to prevent algorithmic subordination. The study concludes by recommending substantive legal reform to ensure fairness and social protection for digital workers
