Symbolic Regulation in Administrative Law: A Study of Laws that Exist without Enforcement

Abstract

This study analyzes the phenomenon of symbolic regulation in administrative law that causes a gap between written norms and implementation. Through a descriptive qualitative method of 15 expert informants and NVivo analysis, it was found that the ambiguity of norms (85%) and operational deficits (90%) triggered the birth of regulations as an instrument of political imagery. As a result, there is a 15-20% budget inefficiency and systemic degradation of public compliance. The conclusion of the study emphasizes the need to reorient the formation of legal products based on the principle of enforceability. Theoretically, the study offers a new framework for bureaucratic pathology, while practically providing recommendations for legislators to formulate norms with sociological validity for accountable governance.
