Reconstruction of the Compensation Model for the Placement of Electric Poles on Freehold Land Based on Corrective Justice, Distributive Justice, and Property Rights

This study aims to analyze the legal provisions regarding such compensation and reconstruct a compensation model based on the principles of Property Rights, Corrective Justice, Distributive Justice, and Energy Justice. The study uses a normative legal method (doctrinal legal research) enriched with a socio-legal approach, through analysis of legislation, literature, documents, and interviews. The results indicate that positive law still leaves a gap in norms related to mechanisms, assessment standards, and legal relationships between the parties, resulting in inconsistent compensation practices, creating legal uncertainty, and not providing optimal protection for community property rights. As a solution, this study proposes a reconstruction of a compensation model that integrates property rights protection, corrective justice, distributive justice, and energy justice through objective assessment standards, written agreements, and effective dispute resolution mechanisms.
